Friends, when we hear the term 'PwD', we naturally think of 'Person with Disabilities'. Our 'PwD Club' (Person with Digi-mate) beautifully combines this very sensitivity with technology and friendship. When we look at the legal documents concerning the rights of persons with disabilities, we realize that a simple and transparent system is everyone's right. Therefore, today's article is an effort to bring us all together and make everyone aware of their rights!

Nalu, I re-read the Government of India's circular dated May 17, 2022. It writes extensively about Reservation in Promotion for PwDs. But tell me, after reading this 14-page 'Mahabharata', will a common employee really understand his rights? Why is this language so complex? Are the mathematics and terms & conditions of reservation in this really beneficial, or are they just bureaucratic red tape?

Abhinav, the question you raised is very profound. This 14-page circular is the pinnacle of legal technicalities. When I analyzed it deeply, I found some important but extremely complex points. See if you can understand this:
- Quantum of Reservation: A total of 4 percent reservation will be given in promotions. This reservation applies from Group 'C' to Group 'B', and Group 'B' to the lowest rung of Group 'A'.
- Five Main Categories: This reservation is divided into five groups: (a) blindness and low vision, (b) deaf and hard of hearing, (c) locomotor disability (including leprosy cured, dwarfism, etc.), (d) autism and mental illness, and (e) multiple disabilities. Each group has about 1 percent reservation.
- The Math of Roster Points: In government language, this is called a '100-point roster'. Points 1, 26, 51, and 76 are reserved for PwDs. If a post is not available at this point, there are extremely complicated rules for carrying it forward to the next point.

Nalu, just reading this makes my head spin! Suppose an employee acquires a disability while in service (Acquired Disability), then what about him? And if the government decides that these rules should not apply to a particular department, is that possible? What are the loopholes in this?

Abhi, you hit the nail on the head. This order provides some 'security shields', but getting them is a big battle:
1. Disability acquired in service: If an employee becomes disabled while in service, he cannot be removed from work or reduced in rank. If he is not suitable for the original job, he will have to be shifted to another post, and until then, a 'Supernumerary Post' will have to be created to pay him.
2. Exemption Loophole: A ministry can exempt itself from this reservation! For this, they just have to go to 'DEPwD' and state the nature of the work as a reason. This is a provision that can often be used to deny rights.
3. Relaxation: If enough candidates are not found, the eligibility criteria can be relaxed. But the power to decide this rests entirely with the 'Head of the Department'.
How Will AI Break This Wall?
The government should at least now hold the hand of technology to deliver these complex-language orders to the public. We have some solid suggestions:
- Auto-summarizer: At the end of every government circular, there should be an AI-generated 'one-pager' that explains the meaning in simple Marathi/Hindi/English.
- Grievance Redressal: This order has a provision for a 'Grievance Redressal Officer' (GRO). It is mandatory to investigate the complaint within 2 months. But why shouldn't this complaint be online and on an AI-based dashboard? Where the victim can know the real-time status of their application.
